The Court held that s.25(1) does not require the prosecution to specify or prove a particular indictable offence; conviction can be based on proof that the property represented the proceeds of an indictable offence and that the accused knew or had reasonable grounds to believe that fact. However, the Court granted leave limited to whether the trial judge fairly assessed the applicant's evidence on the currency exchange explanation and whether that assessment led to an injustice concerning the existence of reasonable grounds to believe the funds were proceeds of crime.
