The Court found credible evidence of clear, repeated express promises and arrangements by the deceased that the Flat would be the Plaintiff's, and that the Plaintiff relied on those promises to her detriment (abandoned a profitable business, made improvements, remained in and treated the Flat as her home); accordingly a constructive trust was established and, alternatively, proprietary estoppel applied, so the trustee was not entitled to possession and must transfer title to the Plaintiff.
