On the balance of probabilities the court found the operative agreement as performed was a HK$5,000,000 purchase of Teng's 15% Sun Plaza interest with a HK$500,000 commission to Pang; Pang received HK$5,000,000 on trust to pay Teng but failed to procure transfer to Wong, misapplied funds and thus breached the trust and is not entitled to the commission; judgment awarded to Wong for HK$5,500,000.
