The warrant of committal was invalid and the detention unlawful because the witness had in fact obeyed the summons and given evidence, there was no refusal falling within s.36(1)(b) CPO, and the judge misapplied contempt powers and failed to observe statutory safeguards and basic principles of natural justice; accordingly habeas corpus was appropriate, the warrant and the underlying order were quashed and the applicant released.
