The court found BIC failed to prove the alleged oral Loan Agreement or that Ms Lie was the source of funds and rejected key documentary evidence as fabricated; consequently BIC's primary and restitution claims in HCA1957/2005 were dismissed. WYD/WYC also failed to prove FEAs, but that did not save BIC. In HCA714/2007 WYD succeeded: the three sums were loans from WYD to BIC and judgment for HK$500,000 awarded with interest.
