The application for leave to appeal is dismissed because (1) any erroneous reference to a higher standard of proof was immaterial as the Tribunal alternatively applied the correct civil standard and found the claimant's case insufficient on that basis; (2) the Tribunal's adverse credibility findings and reliance on contemporaneous documents did not disclose an arguable error of law; and (3) there was no duty to investigate alleged interpretation errors absent concrete particulars; accordingly there is no prospect of success on appeal and leave is refused.
