The court was satisfied that, on the materials placed before it, there was plainly a good arguable case against each defendant for illicit stockpiling, misuse of distributorship arrangements, creation of a misleading website and breach of non-compete obligations; accordingly the Mareva/freeze-related relief granted on an ex parte basis should be continued rather than discharged because the alleged non-disclosures did not, at this stage, undermine the existence of a good arguable case or the risk of dissipation.
