The mareva injunction was refused because ACT failed to establish a good arguable claim of a personal guarantee against Yeung, the misrepresentation claim alone did not establish a real risk of dissipation on the evidence, and significant unexplained delay by ACT further undermined any inference of risk; accordingly it was not just and convenient to grant freezing relief or asset disclosure.
