The court found the risk of enforcement by the Building Authority in respect of the female toilet and other minor contraventions could be safely disregarded and, on the evidence, the defects could have been remedied in time for completion; accordingly the plaintiff's unilateral rescission in April 1998 was wrongful repudiation and the plaintiff could not recover.
