The plaintiff made reasonable and documented attempts to locate the mortgagee and established that the 1957 mortgage remains subsisting; under s12A and the authorities authorising ex parte first‑stage applications, the court exercised its discretion to permit payment into court of HK$10,000 as sufficient to redeem the mortgage, ordered publication of an advertisement to notify interested persons, and permitted a subsequent application under s12A(2) for a declaration that the land be free from the mortgage.
