The court found that the applicants had taken reasonable and sufficient steps to locate the encumbrancer and that the encumbrancer is unknown/untraceable within the meaning of s.12A(1); the applicants are entitled to redeem; the proposed payment of HK$1,000 is reasonable and sufficient to redeem the mortgage and interest; accordingly the court ordered payment of HK$1,000 into court and gave procedural directions for advertisement and subsequent application under s.12A(2).
