Combining the Newton hearing of a guilty co-defendant with the trial of co-defendants who pleaded not guilty permitted inadmissible evidence and participation by a non-party and their counsel, amounted to a material irregularity that rendered the convictions of the appellants unsafe; accordingly the appeals were allowed and convictions quashed with no retrial ordered since sentences had been served.
