The court held that the proposed amendment to introduce an alternative claim for money had and received against D2 should be refused because it was not necessary for disposing fairly or saving costs and would permit the licensed money lender to circumvent the sanctions of the Money Lenders Ordinance; any reduction to principal without interest can be sought under the court's powers in s22(2) or on reopening under s25(1) at trial, so the master erred in granting leave.
