The appeal was dismissed and the strike‑out application refused because the question whether the Plaintiff was a moneylender is fact‑sensitive, disputed facts must be taken in the Plaintiff's favour on strike‑out, and it is not plain and obvious that the contractual claims are bound to fail under s.23 MLO; accordingly the claim cannot be struck out and the Defendants' Notice was dismissed with costs to the Plaintiff.
