The defendant, having accepted custody and exercised meaningful control over the dead ship and possessing the facilities and expertise to take typhoon precautions, owed a duty of care to other harbour users; it breached that duty by failing to ensure the integrity of the guillotine stopper, failing to rig an emergency bower anchor and towing lines and failing to hang off sufficient cable, and those breaches materially caused the vessel to break free and collide with the plaintiffs' installations; judgment granted for plaintiffs on liability.
