The Court of Appeal upheld the judge's discretion to award costs: the invitation and attendance of the putative respondent materially assisted the court and the leave hearings proceeded effectively as substantive hearings; the applications were without merit and academic given the progress of the underlying CAT claims, so costs against the appellants were justified and the appeals against the costs orders were dismissed.
