The first legal chargee was entitled to a possession order as of right because the debt was due, the Master erred in adjourning the possession application sine die in reliance on the second chargee's proceedings, and the court must grant possession to the prior mortgagee subject to procedural requirements; accordingly the appeal was allowed and a possession order was made with a 28‑day period for delivery of vacant possession.
