The trial judge's adverse credibility finding as to Mr Lai was not shown to be wrong, and the documentary evidence relied on by the appellants (the 9 January letter, Exh. HH3 voucher, HK Electric letter, and incorrect debit notes) was insufficient to establish trusteeship or that the auction was a sham; accordingly the appeal failed and the lower court judgment stands.
