The court found the Loan Agreement complied with the MLO, the 1st defendant defaulted, procedural requirements under RDC Orders 83A and 88 were met, the Defence filed without leave was to be ignored, and as mortgagee of a share the plaintiff was entitled to possession and an order for sale under Partition Ordinance s6; accordingly money judgments were entered for the specified sums, vacant possession and an order for sale were granted, and costs were awarded to the plaintiff on a solicitor and own client basis assessed at HK$115,000.00.
