The application was dismissed because the injunction was futile and ineffective (Right Margin was not a party to the arbitration and restraining it would not stop the arbitration) and the steps taken by Right Margin to seize control fell within express mortgage powers and did not raise a serious issue to be tried; accordingly anti-suit relief and interlocutory injunction were not justified and costs were awarded on an indemnity basis.
