On the balance of probabilities the defendant was the contractor because his conduct (quotations, receipt of keys and payments, purchasing materials, finalising accounts, attendance and negotiations) established he was the contracting party or principal responsible for the works; accordingly he was liable for the $150,000 paid to the insurer for lift repairs caused by the decoration works, plus interest.
