The court accepted the evidence that the two deposits into the Company account corresponded to the plaintiff's payments, found the remaining balance represented the plaintiff's money traceable into the account, and held that the bank held that balance on constructive trust for the plaintiff; accordingly a declaration and vesting order directing release of the funds was appropriate subject to agreed undertakings securing the Registrar's costs.
