The Court held that an issue-based costs approach was justified because the issues were distinct and the 1st defendant had no involvement in the Side Gate Issue; accordingly the Costs Order Nisi was varied so there be no order as to costs between the plaintiffs and the 1st defendant in the appeal, the remainder of the Costs Order Nisi as between them is made absolute (including the court below), and the plaintiffs must pay one-third of the 1st defendant's costs of the variation application.
