The plaintiff failed to prove on the balance of probabilities that an oral trust existed or that the CYF shares were beneficially owned by the Deceased/Estate; contemporaneous documents and the available accounting evidence were insufficient and inconsistent to establish the alleged trust, the key payments could not be shown to belong to the Deceased, and the resulting trust argument was misconceived in the circumstances; accordingly the claim is dismissed.
