Because there was no evidence that the Monies remain held by the third parties or have become identifiable assets and because the proposed extension would be draconian and disproportionate given the delay, the court declined to grant the broad variation; the court granted a limited Mareva injunction freezing the three identified Standard Chartered Bank accounts into which the transfers were made and ordered further directions and consideration of ancillary disclosure against the third parties.
