The plaintiff proved, on the balance of probabilities, specific heads of loss (replacement contractor costs, plaintiff's direct labour, rectification, additional materials, vandalism and wages paid) supported by unchallenged expert evidence, but failed to prove that non-conformance deductions and liquidated and ascertained damages reflected losses suffered by the plaintiff attributable to the defendant; accordingly those two items were disallowed and damages were assessed at HK$9,511,087.72.
