Detention remained lawful because a valid deportation order existed, the Director demonstrated an intention to deport and acted with reasonable diligence, and the majority of the period of detention was caused or prolonged by the Applicant's persistent refusal to cooperate with re-entry formalities; accordingly the Hardial Singh criteria (HS1–HS4) were satisfied and habeas corpus relief was refused.
