Although the trial magistrate's credibility findings and acceptance of the prosecution case are not to be lightly displaced, the prosecution's failure to disclose a materially inconsistent earlier statement and the trial magistrate's insufficient consideration of relevant issues (including refusal to inspect the scene) created sufficient irregularity to render the conviction unsafe; accordingly the conviction is quashed and a trial de novo ordered.
