Appeal allowed. HUD did not owe a duty of care to the plaintiffs because, although harm was foreseeable and HUD had taken some precautions and possessed expertise, there was insufficient proximity or assumption of control/responsibility by HUD after the owners took custody; policy and legal distinctions between non-feasance and misfeasance precluded imposing a duty to remedy the owners' omissions in these circumstances.
