Welding operations conducted by the 1st defendant (through its contractors) at the boundary, at height and without adequate precautions constituted a non-natural use and dangerous operation; warnings alone did not discharge the duty of care; the welders and thus the 1st defendant were negligent and the 1st defendant is strictly liable at common law (and under principles akin to Rylands) for the escape of fire; the 2nd defendant is negligent and must indemnify the 1st defendant; the 3rd defendant is not liable on the evidence.
