Plaintiff failed to prove on the balance of probabilities that the surface depression caused the accident; the hearsay statement of the driver was insufficiently reliable and contradicted by probabilities and expert/common sense; accordingly the Crown was not liable and the claim was dismissed. The common law nonfeasance immunity for highway authorities applies in Hong Kong and the Occupiers Liability Ordinance does not assist a highway user in these circumstances.
