Because the termination notice (Form CR 101) was served shortly after 11.10.1999 and the written warning relied on by the landlord was dated 20.10.1999, the statutory precondition in s119E(1)(d) was not satisfied at the time of service; therefore the landlord failed to establish the ground to oppose the grant of a new tenancy and the opposition fails.
