The application to amend was allowed in part: amendments asserting imputed knowledge (that the subcontractor's knowledge could be imputed to the plaintiff) and other minor amendments (including paragraph 3 and a plea of repudiation) were permitted because there was an arguable case and no real prejudice to the plaintiff given existing evidence and time before trial; amendments asserting actual knowledge and the novel legal proposition that a principal cannot rely on ignorance caused solely by lack of reporting systems were rejected for lack of sufficient evidence and authority.
