The 2nd defendant is estopped by the prior judgment from relitigating that she is a contractual licensee; that licence is enforceable only as a contractual licence (no constructive trust arose) and, as against third parties, will bind a purchaser or mortgagee only if there is actual notice or registration; the plaintiff mortgagee is entitled to judgment for possession and sale and the 2nd defendant's claim to a beneficial half-share is dismissed for lack of required detriment/financial contribution.
