The court held that where an action was commenced before but heard after the Amendment, the substantive law in force at the date of the hearing applies; Section 59's transitional provisions are limited to jurisdictional allocation and do not preserve the old substantive law for pending hearings; accordingly the plaintiff's failure to prove service of the notice required by the amended law was fatal and further evidence would not be permitted.
