The Court upheld the use of notional conversion and the application of Chan Chi Ming to the converted quantity; held that the 5‑year sentence at the lower end of the 'substantial' range was not excessive; and held that activating the previously imposed suspended 4‑month sentence was a proper exercise of judicial discretion, therefore dismissing the application.

The court held that notional conversion is permissible where evidence establishes the capability of conversion into a substantially larger saleable quantity; given the evidence of conversion and market usage the trial judges were entitled to sentence on the converted quantities and the imposed sentences were not excessive; leave to appeal out of time for Leung was refused because there was no meritorious grievance.

The Court held that notional conversion may be applied where there is evidence of the capability of conversion; the trial judges were entitled to apply conversion and to depart from strict Chan Chi Ming mixture-only sentencing in the circumstances; accordingly Wong Chi Ling's sentence was not excessive and Leung Kwan's application for leave out of time was refused as his sentence was not wrong.

The Court held the trial judge's directions on corroboration were legally sound because the police evidence of finding cash and written address was independent of accomplice assertions; Cheng Yeung sentencing guidelines should not be applied retrospectively to offences committed before that decision; sentencing must now be based on quantity of the active narcotic (salts of esters of morphine) with specified bands, and appropriate reductions for plea and assistance were ordered in the individual appeals.
