Because the magistrate accepted the appellant's honesty and testimony that he believed the ringtone was legitimately available online but did not adequately explain why an objective standard nonetheless gave him reason to believe it was infringing, the appellate court found a lurking doubt and quashed the conviction and set aside the sentence.
