Evidence established the appellant’s car was parked unattended in the leftmost lane on yellow lines and, by forcing approaching vehicles to divert into the second lane, it was reasonably likely to cause unnecessary obstruction; short duration, alleged private status of the bay and de minimis arguments were insufficient to negate that finding, so conviction and fixed penalty were upheld.

Court accepted the police evidence that the vehicle parked on an unlined passage narrowed the available space such that larger vehicles could be obstructed; a minor discrepancy in lamp‑post numbering did not invalidate the fixed penalty notice because the notice need only indicate the approximate location; prior non‑enforcement did not excuse the offence; thus the conviction was upheld.

Because no application for a summons was made and the statutory duty to issue a summons is triggered only if it is "made to appear" to the magistrate, he was not obliged to summon P.C. 10212; further, the magistrate's specific findings of fact demonstrated that he considered the elements of obstruction and careless driving and were sufficient to support the convictions, so the appeal is dismissed.
