The suspended custodial sentence of six months was excessive in the circumstances; having regard to the appellant's genuine but erroneous belief in title, the repetitive nature of the offence and the need to secure the land for imminent public use, a reduced immediate custodial sentence of three months (to run from the activation date) adequately punished the appellant and protected the land's intended use.
