On the evidence the respondent (Mr Wai) was actively conducting management and directorial functions for the defendant companies (signing cheques, contracting and instructing deliveries), and therefore was an 'officer' for the purposes of Order 48 r.1 (including as a past officer); Master Woolley's setting aside of Master O'Donnell's order was incorrect because the plaintiff's affidavit was not deceptive and the misleading assertions originated with the respondent; the original examination order must be restored and the examination must proceed.
