The Official Solicitor was permitted to withdraw the summons and, on the evidence and legal principles concerning the role and public function of the Official Solicitor, the court held he had acted reasonably and not improperly; accordingly no order was made that the Official Solicitor pay the father's costs and no order was made that the parents should bear the Official Solicitor's costs in relation to the summons, although the court retained discretion to order costs in future if circumstances warranted.
