The court discharged the part of the interim antisuit injunction relating to the WFOE Proceedings because those proceedings arise from the Loan Agreements and Share Pledge Agreements which contain a clear Mainland jurisdiction clause and form the centre of gravity of the dispute; the WFOEs were not parties to the JV Arbitration Agreement and could not show to a high degree of probability that D’s initiation of the WFOE Proceedings breached that Arbitration Agreement.
