The impugned remarks did not undermine the appellant's right to silence or amount to an adverse comment because there was no evidence of assault, the judge properly directed the jury on the right of silence and on assessing admissions and oppression, and when the summing-up is read as a whole the trial remained fair; accordingly the conviction and sentence were safe and the appeal was dismissed.
