Although the defendant was late in disclosing Mr Craft's absence from Hong Kong on 20 May 2000, there was no evidence of deliberate concealment nor evidence that earlier disclosure would have led the plaintiff to conduct the litigation materially differently; the alleged meeting date was only one factor and the plaintiff had an alternative implied JVA case; the one-day adjournment and its costs were already awarded to the plaintiff, so there was no justification to vary the Order nisi; the application was dismissed and the Order nisi confirmed and made absolute.
