Because the Statement of Claim and the Counterclaim are two sides of the same coin and the set aside and striking out summonses address essentially the same issues, it is logical and appropriate to hear all four summonses together; the defendant agreed not to rely on the 2nd Affirmation of Ho, and therefore the court ordered that the four summonses be heard together on 3 June 2002.
