The applications for stay were dismissed because the defendants failed to demonstrate strong grounds of appeal or a realistic risk that the appeals would be rendered nugatory: lis pendens registrations and CCT's undertakings prevented dissipation, and the defendants' delay undermined their claims for a stay; accordingly the court exercised its discretion to refuse stays and ordered costs against the applicants.
