At the date of resumption the applicants were not owners or former owners entitled to compensation because their Block Crown Lease interest had been extinguished by Cap.488 on 8 September 1995 and the putative forfeiture of the sub-lease was ineffective without judgment; therefore the applicants lacked capacity to claim under Cap.370 and the application must be dismissed.
