The personal actions were plainly unsustainable because they sought to impugn ownership of vessels registered in the corporate names contrary to the principle of separate corporate personality and the conclusive effect of vessel registration; the Defendants were therefore justified in bringing strike out applications and are entitled to costs of those applications; the derivative actions exhibited curable pleading and joinder defects and may proceed if amended; given the sale of the vessels the actions should be removed from the Admiralty List and transferred to the General List.
