The personal actions (HCAJ 77 and 78) were unsustainable because the vessels were registered in the names of Hope Ltd and Glory Ltd and registration is normally conclusive of ownership; the defendants were therefore entitled to bring strike out summonses and recover costs; the derivative actions (HCAJ 79 and 80) were defectively pleaded but arguable and amendable, so defendants are entitled to costs of the strike out applications up to and including the costs hearing; the court also ordered removal from the Admiralty List to the General List given the vessels have been sold.
