Convictions for the three theft charges (4,5,6) were quashed because the prosecution failed to prove the appellant lacked authority or that the appropriation was dishonest given company approvals, witness evidence and company chop impressions, creating a lurking doubt; however the conspiracy conviction (charge 9) was upheld because evidence established that the appellant and Madam Ko misrepresented that $820,000 had been paid to Wah Fai and there was insufficient reliable evidence to establish the alleged package deal.
